    1. About Epic Seafood

    These Terms and Conditions govern your use of epic.be and any commercial relationship you enter into with Hottlet NV, trading as Epic Seafood, registered in Belgium under company number BE0403.656.986 (hereinafter referred to as "Epic", "we", or "us").

    2. Application

    These terms apply to all use of our website and to all commercial agreements between Epic and its customers. By accessing epic.be or placing an order with us, you agree to be bound by these terms.

    These terms take precedence over any general purchasing conditions of the buyer, unless explicitly agreed otherwise in writing by a duly authorised representative of Epic.

    3. Products and Orders

    All products are subject to availability. We reserve the right to modify our product range at any time without prior notice. Product descriptions, specifications, and images are provided for informational purposes and may vary slightly from the actual products delivered.

    Orders placed with Epic are binding upon written confirmation from us. We reserve the right to refuse or cancel any order at our sole discretion, for example, in cases of pricing errors, stock unavailability, or concerns regarding the buyer's creditworthiness.

    4. Pricing and Payment

    All prices are quoted in euros and exclude VAT and applicable taxes unless stated otherwise. Taxes and duties will be added at the point of invoicing. We reserve the right to adjust prices without prior notice, except for orders that have already been confirmed in writing.

    Payment terms are as agreed per customer account. Invoices not paid by the due date will automatically incur interest at the statutory Belgian commercial interest rate (as defined in the Law of 2 August 2002 on combating late payment), plus a fixed administrative charge.

    5. Delivery

    Delivery dates communicated by Epic are indicative only and do not constitute a contractual obligation. We will make every effort to deliver within the agreed timeframe. Epic shall not be liable for delays caused by events outside our reasonable control, including but not limited to adverse weather, transport strikes, or supply chain disruptions (force majeure).

    Risk of loss or damage passes to the buyer upon delivery to the agreed delivery point. The buyer must inspect goods upon receipt. Any claims relating to visible damage or quantity discrepancies must be noted on the delivery receipt at the time of delivery and reported to Epic in writing within 24 hours.

    6. Cold Chain and Food Safety

    Our frozen seafood products are transported under strict temperature-controlled conditions in accordance with applicable EU food safety regulations (EC 853/2004, EC 852/2004). Upon receipt, the buyer assumes full responsibility for maintaining the cold chain, storing products at the temperature specified on the packaging, and complying with all applicable food safety regulations regarding storage, handling, and resale.

    Epic certifies that all products leaving our Kontich distribution centre meet the required temperature and quality standards documented in our HACCP procedures.

    7. Complaints and Returns

    Any complaints regarding product quality, quantity, or condition must be submitted to Epic in writing within 48 hours of delivery, accompanied by supporting evidence including photographs, batch numbers, and temperature logs where applicable. We will investigate all complaints and respond within 5 working days.

    Returns are only accepted with prior written approval from Epic. Unauthorised returns will not be processed. Approved returns must be transported under appropriate temperature conditions, at the buyer's cost, unless the return is due to an error on Epic's part.

    8. Intellectual Property

    All content on epic.be, including but not limited to text, images, logos, videos, product photography, and website design, is the intellectual property of Hottlet NV or its licensors and is protected by Belgian and international copyright law. Reproduction, distribution, modification, or use of any content without prior written consent from Epic is strictly prohibited.

    9. Limitation of Liability

    Epic's total liability arising from or in connection with a commercial transaction is limited to the net invoice value of the products directly concerned. We shall not be liable for any indirect, consequential, incidental, special, or punitive damages, including but not limited to loss of profit, loss of business, or loss of data, howsoever arising.

    Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under Belgian law.

    10. Privacy

    The collection and use of personal data in connection with your use of epic.be or your business relationship with Epic is governed by our Privacy Policy. By doing business with us, you confirm you have read and understood this policy.

    11. Governing Law and Jurisdiction

    These Terms and Conditions are governed exclusively by Belgian law. Any dispute arising from or related to these terms, or to any commercial agreement with Epic, shall be submitted to the exclusive jurisdiction of the competent courts of the judicial district of Antwerp, unless mandatory legal provisions require otherwise.

    12. Modifications

    Epic reserves the right to update these Terms and Conditions at any time. The version published on this page at the time of your visit or order applies. Significant changes will be communicated to registered customers by email where practicable.
